Peer Review Process

Manuscripts proposed to Jurnal Penegakan Hukum dan Keadilan (JPHK) must be in focus and scope and follow the author’s guidelines in JPHK. Manuscripts must have novelty and no malpractice. All manuscripts that have been submitted to JPHK will go through a peer-review process using a “double-blind review” system (the identity of the reviewer/reviewer and author is hidden/anonymous). Manuscripts will be reviewed by external reviewers and handled by the editor.
The review process considers the relevance and contribution of articles to legal theory and practice. Editors and reviewers provide constructive input on the evaluation results to the authors. The article review process usually takes 4 to 12 weeks, depending on the duration of the editor and reviewer reviewing the manuscript. The stages of the review process applied are as follows:
1. Manuscript submissions are processed through the JPHK’s Open Journal System (OJS), website: https://journal.umy.ac.id/index.php/jphk/index
2. Incoming manuscripts will be checked for suitability of author guidelines, templates, plagiarism, focus and scope by the editor-in-chief. If appropriate, the process continues with the appointment of the relevant editor. However, if not appropriate, the editor-in-chief will recommend that the manuscript be “resubmitted for review” and rejected.
3. Plagiarism will be checked using Turnitin. If the level of similarity is more than 20%, then the manuscript will be asked to be corrected or rejected by the editor. This decision is final and entirely the prerogative of the JPHK editor.
4. Manuscripts will be sent to at least 1 (one) reviewer. If peer-review is required, a 2nd or even 3rd reviewer will be appointed for further consideration.
5. The reviewer will then send a review note to the editor, and it will be forwarded to the author by the editor.
6. Accepted manuscripts that require revision (minor or major) will contain comments from reviewers and will be returned to the author for revision. The reviewer’s task is to suggest whether the manuscript is accepted or rejected. At the same time, the final decision regarding the manuscript’s acceptance or rejection for publication is in the hands of the editors and editor-in-chief.
7. Authors are given time to revise the manuscript no later than one month. Additional time to revise is up to the editorial board.
8. Manuscripts that have gone through the final revision and are accepted by the editors will be published in JPHK in the edition determined by the editor-in-chief.

Notes for Decision:
1. Accepted
2. Accepted with Minor Revisions (publication is desired, but a limited number of changes are still required)
3. Received with Major Revision (requires considerable rework before reconsideration)
4. Rejected (generally for reasons beyond the scope and purpose, major technical description problems, lack of clarity of presentation)

R-W Policy

Policy Statement
Jurnal Penegakan Hukum dan Keadilan (JPHK) acknowledges that the authors have properly prepared the manuscript, and the editors have carried out the peer-review process. However, for research purposes, there is a possibility that published articles will be deleted or withdrawn even if only done in an unnatural situation. This policy refers to COPE (Committee on Publication Ethics).

Retraction
Editors will consider retracting a publication if:

  1. They have clear evidence that the findings are unreliable, either as a result of a major error (e.g., miscalculation or experimental error) or as a result of fabrication (e.g., of data) or falsification (e.g., image manipulation)
  2. It constitutes plagiarism
  3. The findings have previously been published elsewhere without proper attribution to previous sources or disclosure to the editor, permission to republish, or justification (i.e., cases of redundant publication)
  4. It contains material or data without authorization for use
  5. Copyright has been infringed, or there is some other serious legal issue (e.g., libel, privacy)
  6. It reports unethical research
  7. It has been published solely based on a compromised or manipulated peer review process
  8. The author(s) failed to disclose a major competing interest (aka, conflict of interest) that would have unduly affected interpretations of the work or recommendations by editors and peer reviewers in the editor’s view.
Withdrawal
The authors are requested not to withdraw the manuscript that is being processed at JPHK. The withdrawal process is a waste of valuable resources for the editor to process the submitted manuscripts.
